{"id":1000006673,"date":"2022-08-13T11:54:00","date_gmt":"2022-08-13T09:54:00","guid":{"rendered":"https:\/\/forum-engagement.org\/?p=1000006673"},"modified":"2022-07-29T11:58:51","modified_gmt":"2022-07-29T09:58:51","slug":"gestion-de-fin-de-carrieres-les-propositions-de-la-cpme","status":"publish","type":"post","link":"https:\/\/forum-engagement.org\/2024\/gestion-de-fin-de-carrieres-les-propositions-de-la-cpme\/","title":{"rendered":"Gestion de fin de carri\u00e8res : les propositions de la CPME"},"content":{"rendered":"\n<p>D\u00e9termination de l&rsquo;\u00e2ge d&rsquo;un senior, recrutement et maintien dans l&#8217;emploi&#8230; d\u00e9couvrez les\u00a0propositions de la CPME en faveur de l&#8217;emploi des seniors.<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Fixer l\u2019\u00e2ge \u00e0 partir duquel on est consid\u00e9r\u00e9 comme senior, \u00e0 57 ans.<\/li><li>Favoriser le recrutement et le maintien dans l\u2019emploi des seniors en exon\u00e9rant les entreprises, de cotisations patronales au r\u00e9gime d\u2019assurance ch\u00f4mage pour les salari\u00e9s consid\u00e9r\u00e9s comme seniors.<\/li><li>Autoriser l\u2019abondement du Compte Personnel de Formation (CPF) des seniors, par les entreprises et les r\u00e9gions et d\u00e9plafonner les droits acquis \u00e0 partir de 45 ans.&nbsp;<\/li><li>Limiter les co\u00fbts financiers induits par la reconnaissance d\u2019une maladie professionnelle proportionnellement au temps pass\u00e9 dans l\u2019entreprise, pour \u00e9viter de p\u00e9naliser l\u2019embauche des salari\u00e9s \u00e2g\u00e9s.&nbsp;<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">D\u00e9termination de l\u2019\u00e2ge d\u2019un senior<\/h2>\n\n\n\n<p>1.&nbsp;Il convient de proc\u00e9der \u00e0 un alignement de la d\u00e9finition d\u2019un senior -ouvrant notamment droit \u00e0 l\u2019allongement de la dur\u00e9e d\u2019indemnisation- sur l\u2019\u00e2ge retenu dans le cadre des r\u00e8gles de non-d\u00e9gressivit\u00e9 de l\u2019assurance ch\u00f4mage, soit 57 ans.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Recrutement et maintien dans l\u2019emploi des seniors<\/h2>\n\n\n\n<p>2.&nbsp;Afin de cr\u00e9er un contexte favorable pour favoriser le recrutement et le maintien dans l\u2019emploi des seniors,&nbsp;<strong>la CPME propose une exon\u00e9ration des cotisations patronales au r\u00e9gime d\u2019assurance ch\u00f4mage durant la p\u00e9riode d\u2019emploi d\u2019un senior.<\/strong><\/p>\n\n\n\n<p>Il conviendrait d\u00e8s lors que les partenaires sociaux repr\u00e9sentatifs au niveau national interprofessionnel actent ce point au travers d\u2019un accord afin qu\u2019un avenant \u00e0 la convention relative \u00e0 l\u2019indemnisation de ch\u00f4mage puisse faire l\u2019objet d\u2019un agr\u00e9ment.<\/p>\n\n\n\n<p><br>3.&nbsp;Afin de favoriser le maintien dans l\u2019emploi des s\u00e9niors il convient d\u2019utiliser le levier de la formation professionnelle. Or actuellement les s\u00e9niors font partie des cat\u00e9gories d\u2019actifs qui se forment le moins et le taux d\u2019acc\u00e8s \u00e0 la formation d\u00e9croit avec l\u2019\u00e2ge. Il est donc n\u00e9cessaire de rendre notre syst\u00e8me de formation plus attractif et plus visible pour les s\u00e9niors.<\/p>\n\n\n\n<p>C\u2019est pourquoi la CPME propose d\u2019adapter le nouveau Compte Personnel de Formation (CPF) en autorisant les entreprises et les r\u00e9gions \u00e0 l\u2019abonder pour les s\u00e9niors. Il pourrait m\u00eame \u00eatre envisag\u00e9 de d\u00e9plafonner les droits acquis \u00e0 partir de 45 ans permettant l\u2019\u00e9volution vers un syst\u00e8me de compte \u00e9pargne formation.&nbsp;<\/p>\n\n\n\n<p><br>4.&nbsp;Afin de favoriser le recrutement des seniors, il y a lieu de modifier les r\u00e8gles applicables en mati\u00e8re d\u2019inaptitude d\u2019origine professionnelle.<\/p>\n\n\n\n<p>En effet, un accident de travail ou une maladie professionnelle d\u00e9clar\u00e9e chez le dernier employeur le contraint \u00e0 g\u00e9rer la proc\u00e9dure de reconnaissance de celle-ci.<br>Dans le cas d\u2019une maladie professionnelle, il arrive bien souvent que les activit\u00e9s ant\u00e9rieures du salari\u00e9 chez ses pr\u00e9c\u00e9dents employeurs soient \u00e9galement \u00e0 l\u2019origine de tout ou partie de cette maladie professionnelle.<br>Le dernier employeur a la possibilit\u00e9 de d\u00e9montrer qu\u2019elle est imputable \u00e0 d\u2019autres entreprises mais il est g\u00e9n\u00e9ralement dans l\u2019impossibilit\u00e9 d\u2019avoir acc\u00e8s aux \u00e9l\u00e9ments n\u00e9cessaires, notamment si le ou les pr\u00e9c\u00e9dentes entreprises ont disparu.<br>Il devra alors supporter les frais li\u00e9s \u00e0 la rupture pour inaptitude physique (indemnit\u00e9 compensatrice en cas d\u2019inex\u00e9cution du pr\u00e9avis, par ailleurs prise en compte pour d\u00e9terminer l\u2019anciennet\u00e9 acquise au jour de la rupture du contrat et surtout indemnit\u00e9 sp\u00e9ciale de licenciement au moins \u00e9gale au double de l\u2019indemnit\u00e9 l\u00e9gale de licenciement) et \u00e9galement les cotisations suppl\u00e9mentaires en mati\u00e8re d\u2019ATMP.<\/p>\n\n\n\n<p>Ceci conduit indiscutablement les \u00e9ventuels employeurs de personnes seniors en recherche d\u2019emploi \u00e0 \u00eatre r\u00e9ticents \u00e0 prendre un tel risque.<\/p>\n\n\n\n<p>D\u00e8s lors, la CPME propose que l<strong>es co\u00fbts g\u00e9n\u00e9r\u00e9s par la reconnaissance d\u2019une maladie professionnelle conduisant \u00e0 la reconnaissance de l\u2019inaptitude ne soient pas \u00e0 la charge exclusive du dernier employeur, si cette maladie lui est partiellement imputable<\/strong>, mais uniquement proportionnellement au temps pass\u00e9 dans l\u2019entreprise.<br>Dans le cas o\u00f9 l\u2019employeur ne peut avoir acc\u00e8s aux \u00e9l\u00e9ments qui auraient pu lui permettre de d\u00e9montrer que la maladie professionnelle n\u2019est pas uniquement imputable \u00e0 l\u2019activit\u00e9 de son entreprise,<strong>&nbsp;le co\u00fbt financier en r\u00e9sultant devrait \u00eatre \u00e9quitablement r\u00e9parti entre le dernier employeur (prorata temporis) et un fonds mutualis\u00e9 d\u00e9di\u00e9, financ\u00e9 par la branche ATMP&nbsp;<\/strong>(qui ne cesse de d\u00e9gager des exc\u00e9dents).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Documents utiles<\/h3>\n\n\n\n<p><a href=\"https:\/\/www.cpme.fr\/file_download?k=1398:079d6221db19216bfbd2b3a010b87333\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a>>> <a href=\"https:\/\/www.cpme.fr\/file_download?k=1398:079d6221db19216bfbd2b3a010b87333\" target=\"_blank\" rel=\"noreferrer noopener\">LES PROPOSITIONS DE LA CPME EN MATI\u00c8RE DE GESTION DE FIN DE CARRI\u00c8RE<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>D\u00e9termination de l&rsquo;\u00e2ge d&rsquo;un senior, recrutement et maintien dans l&#8217;emploi&#8230; d\u00e9couvrez les\u00a0propositions de la CPME en faveur de l&#8217;emploi des seniors.
