{"id":1000012973,"date":"2023-08-29T14:59:47","date_gmt":"2023-08-29T12:59:47","guid":{"rendered":"https:\/\/forum-engagement.org\/?p=1000012973"},"modified":"2023-08-29T14:59:48","modified_gmt":"2023-08-29T12:59:48","slug":"reglement-ecodesign-le-conseil-adopte-son-approche-generale","status":"publish","type":"post","link":"https:\/\/forum-engagement.org\/2024\/reglement-ecodesign-le-conseil-adopte-son-approche-generale\/","title":{"rendered":"R\u00e8glement ecodesign : le Conseil adopte son approche g\u00e9n\u00e9rale."},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">DROIT EUROP\u00c9EN ET POLITIQUES PUBLIQUES<\/h2>\n\n\n\n<p>Le Conseil Comp\u00e9titivit\u00e9 du 22 mai 2023 a adopt\u00e9 son approche g\u00e9n\u00e9rale sur la proposition de r\u00e8glement de la Commission europ\u00e9enne \u00e9tablissant un cadre pour la fixation d&rsquo;exigences en mati\u00e8re d&rsquo;\u00e9coconception applicables aux produits durables et abrogeant la directive 2009\/125\/CE, pr\u00e9sent\u00e9e le 30 mars 2022. Ce texte, qui constitue un \u00e9l\u00e9ment cl\u00e9 du plan d&rsquo;action de la Commission europ\u00e9enne pour l&rsquo;\u00e9conomie circulaire, fixe des normes visant \u00e0 faciliter la r\u00e9paration, la modernisation et le recyclage d&rsquo;une s\u00e9rie de produits, notamment \u00e9lectroniques, textiles, m\u00e9talliques, d&rsquo;ameublement et chimiques.&nbsp;<\/p>\n\n\n\n<p>Les positions des Etats membres \u00e9taient loin d\u2019\u00eatre harmonis\u00e9es (<a href=\"https:\/\/www.august-debouzy.com\/fr\/blog\/1928-la-proposition-de-reglement-packaging-ppwr-prend-un-carton-jaune-au-conseil\">voir AD Europe mars 2023<\/a>) avec un groupe de 5 pays (France, Allemagne, Belgique, Autriche, Pays-Bas) portant une vision plus exigeante. Ceux-ci ont r\u00e9ussi \u00e0 faire valoir plusieurs de leurs points de vue.&nbsp;<\/p>\n\n\n\n<p>Les discussions ont notamment port\u00e9 le degr\u00e9 d&rsquo;harmonisation, l&rsquo;interdiction de d\u00e9truire les produits de consommation invendus, le passeport num\u00e9rique des produits, le r\u00f4le des autorit\u00e9s douani\u00e8res et des autorit\u00e9s de surveillance du march\u00e9, la charge administrative pour les PME, les march\u00e9s publics \u00e9cologiques et l&rsquo;habilitation de la Commission \u00e0 adopter les exigences en mati\u00e8re d&rsquo;\u00e9coconception, y compris la mani\u00e8re d&rsquo;assurer une participation appropri\u00e9e des Etats membres \u00e0 ce processus.&nbsp;<\/p>\n\n\n\n<p>Ainsi, l&rsquo;approche g\u00e9n\u00e9rale introduit une interdiction de la destruction des textiles, des chaussures et des v\u00eatements, avec une d\u00e9rogation de quatre ans pour les entreprises de taille moyenne et une d\u00e9rogation g\u00e9n\u00e9rale pour les petites et microentreprises. \u202fPour rappel, la Commission privil\u00e9giait une approche en deux temps, en demandant d&rsquo;abord aux entreprises de divulguer le nombre de produits invendus qu&rsquo;elles d\u00e9truisent chaque ann\u00e9e, avant d&rsquo;envisager une interdiction de cette pratique.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Dans son texte, le Conseil propose \u00e9galement d&rsquo;ajouter plusieurs exigences \u00e0 une liste de normes que tous les produits vis\u00e9s devront respecter. Ces exigences concernent l&rsquo;utilisation rationnelle de l&rsquo;eau, l\u2019empreinte carbone et environnementale, la contribution au changement climatique, l&rsquo;impact sur la pollution de l&rsquo;air, de l&rsquo;eau et du sol, ainsi que l&rsquo;utilisation des sols. Le compromis sugg\u00e8re \u00e9galement d&rsquo;envisager l&rsquo;insertion d&rsquo;une obligation pour les entreprises de pr\u00e9venir l'\u00a0\u00bbobsolescence pr\u00e9matur\u00e9e\u00a0\u00bb des produits concern\u00e9s. En vertu de ces nouvelles r\u00e8gles, tous les produits disposeront d&rsquo;un passeport num\u00e9rique contenant des informations cl\u00e9s sur leur durabilit\u00e9. Le contenu num\u00e9rique qui fait partie int\u00e9grante d&rsquo;un produit physique devrait \u00e9galement \u00eatre inclus dans le champ d&rsquo;application du r\u00e8glement.&nbsp;<\/p>\n\n\n\n<p>La Commission serait habilit\u00e9e \u00e0 adopter des actes d\u00e9l\u00e9gu\u00e9s pour compl\u00e9ter le r\u00e8glement en \u00e9tablissant des exigences d&rsquo;\u00e9coconception afin d&rsquo;am\u00e9liorer la durabilit\u00e9 environnementale des produits.&nbsp;<\/p>\n\n\n\n<p>Cette approche g\u00e9n\u00e9rale donne \u00e0 la pr\u00e9sidence du Conseil un mandat pour les n\u00e9gociations avec le Parlement europ\u00e9en quand\u00a0se sera prononc\u00e9 \u00e0 son tour.
