href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/?uri=CELEX%3A52021PC0706&amp;qid=1684062528578\" rel=\"noreferrer noopener\" target=\"_blank\">r\u00e8glement<\/a>&nbsp;relatif \u00e0 la mise \u00e0 disposition sur le march\u00e9 de l\u2019Union ainsi qu\u2019\u00e0 l\u2019exportation \u00e0 partir de l\u2019Union de certains produits de base et produits associ\u00e9s \u00e0 la d\u00e9forestation et \u00e0 la d\u00e9gradation des for\u00eats.&nbsp;<\/p>\n\n\n\n<p>Ce r\u00e8glement compl\u00e8te l\u2019arsenal l\u00e9gislatif europ\u00e9en en mati\u00e8re environnementale et vise \u00e0 r\u00e9duire la contribution de l\u2019Union europ\u00e9enne \u00e0 la d\u00e9forestation et \u00e0 la d\u00e9gradation de for\u00eats dans le monde en interdisant l\u2019importation et l\u2019exportation \u00e0 partir du march\u00e9 de l\u2019Union de certains produits tels que le cacao, le caf\u00e9, l\u2019huile de palme, le soja, le bois, le caoutchouc, le bois, les bovins ainsi de leurs produits d\u00e9riv\u00e9s si ces produits sont issus de terres d\u00e9bois\u00e9es ou de for\u00eats d\u00e9grad\u00e9es apr\u00e8s le 31 d\u00e9cembre 2020.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Les produits en cause ne pourront \u00eatre import\u00e9s ou export\u00e9s depuis l\u2019Union europ\u00e9enne que s\u2019ils r\u00e9pondent aux trois conditions cumulatives suivantes\u202f: ils sont \u00ab\u202fz\u00e9ro d\u00e9forestation\u202f\u00bb, c\u2019est-\u00e0-dire que les produits ont \u00e9t\u00e9 produits sur des terres n\u2019ayant pas fait l\u2019objet d\u2019activit\u00e9 de d\u00e9forestation apr\u00e8s le 31 d\u00e9cembre 2020\u202f; ils ont \u00e9t\u00e9 produits conform\u00e9ment \u00e0 la l\u00e9gislation pertinente du pays de production\u202f; ils font l\u2019objet d\u2019une d\u00e9claration de diligence raisonn\u00e9e.&nbsp;&nbsp;<\/p>\n\n\n\n<p>La diligence raisonn\u00e9e comprend notamment la collecte d\u2019informations, de documents et de donn\u00e9es (par exemple, les coordonn\u00e9es g\u00e9ographiques des parcelles de production) attestant la conformit\u00e9 des produits concern\u00e9s et garantissant que le produit comporte un risque z\u00e9ro ou n\u00e9gligeable de d\u00e9forestation.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Les activit\u00e9s des op\u00e9rateurs et commer\u00e7ants seront ensuite contr\u00f4l\u00e9es par les autorit\u00e9s comp\u00e9tentes de chaque Etat membre en fonction du niveau de risque du pays conform\u00e9ment \u00e0 l\u2019article 29 du r\u00e8glement : \u00e0 hauteur de 9% pour les pays \u00e0 risque \u00e9lev\u00e9, 3% pour ceux \u00e0 risque standard et de 1% pour ceux \u00e0 risque faible.&nbsp;<\/p>\n\n\n\n<p>Enfin, ce m\u00e9canisme de contr\u00f4le est assorti de sanctions en cas de manquement telles que des amendes d&rsquo;au moins 4% du chiffre d&rsquo;affaires annuel de l\u2019op\u00e9rateur ou du commer\u00e7ant dans l&rsquo;Union europ\u00e9enne ou encore des exclusions temporaires des proc\u00e9dures de passation de march\u00e9s publics et de l&rsquo;acc\u00e8s au financement public.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>INDUSTRIE &#8211; PROJETS
